Following a thorough assessment of the employer’s conduct, the appropriate action is taken in accordance with the requirements of the law. For example, where the employer has failed to put in place an internal company policy and a privacy notice concerning access to the internet and the employee’s email account, the Firm assesses with the client whether it would be appropriate to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali) pursuant to Article 77 of Regulation (EU) 2016/679 and Articles 140-bis and 143 of the Italian Personal Data Protection Code, as well as any further solutions that may be appropriate in the specific circumstances of the case.
